1. Purpose
xTensium Studio is committed to ensuring equal opportunity for all participants in our training programs. This policy establishes a procedure for resolving complaints of discrimination in accordance with the Workforce Innovation and Opportunity Act (WIOA) Section 188, 29 CFR Part 38, and applicable state and federal civil rights laws.
2. Coverage
This policy applies to:
- All applicants to xTensium Studio training programs
- All participants currently enrolled in training programs
- All program completers during the post-completion tracking period
- Any individual who believes they have been discriminated against in connection with a WIOA Title I program or activity
3. Protected Categories
xTensium Studio prohibits discrimination on the basis of: race, color, religion, sex (including pregnancy, childbirth, and related medical conditions, sex stereotyping, transgender status, and gender identity), national origin (including limited English proficiency), age, disability, political affiliation or belief, citizenship status, or participation in any WIOA Title I-financially assisted program or activity.
4. How to File a Complaint
Any individual who believes they have been subjected to discrimination may file a complaint:

5. Complaint Requirements
A complaint must include:
- The complainant's name, address, and contact information
- The identity of the respondent (the person or organization alleged to have discriminated)
- A description of the complainant's allegations, including enough detail to understand what happened, when it happened, and the basis for the complaint
- The complainant's signature or the signature of their authorized representative
6. Investigation Process
- Acknowledgment: xTensium Studio will acknowledge receipt of the complaint in writing within 5 business days.
- Investigation: The EO Officer will conduct a thorough investigation, which may include interviews, document review, and consultation with relevant parties.
- Resolution: xTensium Studio will issue a written Notice of Final Action within 90 days of the complaint filing.
- Appeal: If the complainant is dissatisfied with the resolution, they may file an appeal with the Civil Rights Center within 30 days of receiving the Notice of Final Action.
7. Retaliation Prohibited
xTensium Studio strictly prohibits intimidation, threats, coercion, or discrimination against any individual for the purpose of interfering with any right or privilege secured by Section 188 of WIOA or 29 CFR Part 38, or because the individual has filed a complaint, testified, assisted, or participated in any manner in an investigation or hearing.

9. Confidentiality
xTensium Studio will maintain the confidentiality of all complaint-related information to the extent possible, consistent with a thorough investigation and applicable law. Personal information collected during the complaint process, including demographic data, will be used solely for investigation and compliance monitoring purposes and will be stored securely.
