These Terms of Service ("Terms") govern your use of the xTensium Studio platform and related services ("Service") operated by xTensium ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

xTensium Studio is an AI-powered platform that enables industry professionals to generate custom business applications. The Service includes application generation, AI analysis tools, training content, and related features available through your subscription plan.

2. Account Registration

To use the Service, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

3. Subscription and Payment

  • Access to the Service requires a paid subscription plan
  • Subscriptions are billed annually at the rates listed on our pricing page
  • Prices are subject to change with reasonable notice
  • Refunds are handled on a case-by-case basis; contact us within 14 days of purchase for refund requests
  • Failure to maintain payment may result in suspension of your account

4. Intellectual Property

Your Content

You retain ownership of all content you provide to the platform, including your business configurations, uploaded documents, and domain expertise. Applications generated through the platform are yours to use, deploy, and commercialize.

Our Platform

The xTensium Studio platform, including its code, design, features, training content, and documentation, is owned by xTensium and protected by intellectual property laws. Your subscription grants you a license to use the platform, not ownership of it.

5. Acceptable Use

You agree not to use the Service to:

  • Generate applications for illegal purposes or activities
  • Infringe on the intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Attempt to gain unauthorized access to the platform or other users' accounts
  • Resell or redistribute the platform itself (generated applications are yours)
  • Use the Service in ways that could damage, disable, or impair the platform

6. AI-Generated Content

The Service uses artificial intelligence to generate applications and analysis. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and validating all generated content before use in production environments.

We do not guarantee that AI-generated applications will be free of defects or suitable for any particular purpose without your review and customization.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, xTensium shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Termination

Either party may terminate the subscription at any time. Upon termination:

  • Applications you have already generated and deployed will continue to function
  • You will lose access to the platform's generation and management tools
  • You may request an export of your data within 30 days of termination
  • We reserve the right to terminate accounts that violate these Terms

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to conflict of law provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
